Triumph Together respects the privacy of the children, families, donors, volunteers, athletes, partners, and other individuals who interact with our organization.

Triumph Together is a program operated by Project Outrun, a nonprofit organization. This Privacy Policy explains how Project Outrun, through the Triumph Together program (“Triumph Together,” “Project Outrun,” “we,” “us,” or “our”), collects, uses, discloses, and protects information when you visit triumphtogether.net (the “Site”), submit an application, contact us, donate, participate in an experience, or otherwise interact with us.

Because Triumph Together serves children and families affected by serious illnesses, some information submitted to us may be sensitive. We encourage parents and legal guardians to review this Privacy Policy carefully before submitting an application.

1. Information We Collect

The information we collect depends on how you interact with Triumph Together.

Information You Provide Directly

We may collect information that you voluntarily provide through the Site, email, telephone, application forms, event registrations, donations, or other communications.

This information may include:

• your name;
• email address;
• telephone number;
• mailing address or general location;
• parent or legal guardian name and contact information;
• a child’s name;
• a child’s age;
• gender information, when provided;
• city and state of residence;
• information about a child’s illness, diagnosis, treatment, or treatment status;
• favorite sports, teams, players, or athletes;
• clothing or shirt size;
• information concerning immediate family members or the number of family members who may attend an experience;
• social media information that you voluntarily provide;
• experience requests or preferences;
• correspondence and messages you send to us;
• volunteer, sponsor, donor, or partnership information;
• donation and transaction-related information; and
• other information you choose to provide.

We ask that you provide only the information reasonably necessary for us to evaluate an application, coordinate an experience, respond to your request, or provide the applicable service.

Unless specifically requested, please do not send complete medical records, Social Security numbers, insurance records, financial account information, or other information that is unnecessary for an application.

2. Sensitive and Health-Related Information

Applications for Triumph Together experiences may include information concerning a child’s diagnosis, illness, treatment, or medical circumstances.

We consider this information sensitive and use it primarily to:

• evaluate applications;
• understand the circumstances of the child and family;
• determine whether an experience may be appropriate;
• coordinate an approved experience;
• communicate with a parent or legal guardian;
• make appropriate arrangements with participating organizations when necessary; and
• administer and improve Triumph Together programs.

We do not require families to provide more health information than is reasonably necessary for these purposes.

Health-related information submitted directly to Triumph Together should not be used as a substitute for communications with a healthcare provider. Triumph Together and Project Outrun do not provide medical advice or medical treatment.

3. Information About Children

Triumph Together provides experiences benefiting children, but applications should be submitted by a parent, legal guardian, caregiver with appropriate authority, healthcare professional with appropriate authorization, or another authorized adult.

Children under 13 should not submit personal information directly to us through the Site without involvement and authorization from a parent or legal guardian.

If you submit information concerning a child, you represent that you are authorized to provide that information to us.

If we learn that personal information was submitted directly by a child in circumstances where legally required parental consent was not obtained, we may take reasonable steps to delete the information.

Parents and legal guardians may contact us to ask about personal information we maintain concerning their child and, where appropriate or required by law, request access, correction, or deletion.

4. How We Use Information

We may use information we collect to:

• receive and review applications;
• determine potential eligibility for Triumph Together programs;
• communicate with applicants and their families;
• coordinate experiences involving athletes, teams, venues, sponsors, and other participating organizations;
• arrange tickets, events, merchandise, meet-and-greets, videos, messages, or similar experiences;
• address accessibility or accommodation requests;
• respond to questions and other communications;
• process donations or transactions;
• maintain donor and supporter records;
• coordinate volunteers, sponsors, and partners;
• administer events;
• send communications that you have requested or consented to receive;
• operate, maintain, secure, and improve the Site;
• understand how visitors use the Site;
• detect fraud, misuse, or security incidents;
• maintain appropriate organizational records;
• comply with applicable laws and legal obligations; and
• protect the safety, rights, and interests of Project Outrun, Triumph Together, participants, families, and others.

We may also use information for another purpose disclosed to you when the information is collected or with your consent.

5. How We Share Information

We do not disclose personal information simply because it has been submitted through an application.

We may share information when reasonably necessary with the following categories of recipients.

Athletes, Teams, Venues, and Experience Partners

If an applicant is selected for an experience, we may share limited information with athletes, sports teams, universities, leagues, venues, sponsors, event organizers, volunteers, or other partners when reasonably necessary to arrange or provide the experience.

Whenever practicable, we seek to limit information shared with these parties to what is reasonably necessary for the applicable purpose.

We do not intend to provide detailed medical information to an athlete, team, venue, or sponsor unless it is necessary to coordinate an experience, you have authorized the disclosure, or another lawful basis applies.

Service Providers

We may use companies and individuals that help us operate our organization and Site, such as:

• website hosting and website platform providers;
• form and database providers;
• cloud storage providers;
• email and communications services;
• analytics providers;
• donation and payment processors;
• event registration services;
• technology consultants; and
• other administrative service providers.

These providers may process information on our behalf or according to their respective terms and privacy practices.

Legal, Safety, and Organizational Requirements

We may disclose information when we reasonably believe disclosure is necessary to:

• comply with applicable law, regulation, legal process, subpoena, or governmental request;
• protect the rights, property, or safety of a child, family, participant, Project Outrun, Triumph Together, or another person;
• investigate suspected fraud, abuse, security incidents, or unlawful activity;
• enforce our Terms & Conditions; or
• establish, exercise, or defend legal claims.

Organizational Changes

If Triumph Together, Project Outrun, or a portion of our programs undergoes a restructuring, merger, transfer, consolidation, or similar organizational change, relevant information may be transferred as part of that transition, subject to applicable law.

6. Google Analytics

The Site uses Google Analytics, a website analytics service provided by Google.

Google Analytics helps us understand how visitors interact with the Site so we can evaluate traffic, improve website performance, understand which pages and content are useful, and improve our programs and outreach.

Google Analytics may collect or process information such as:

• cookies or similar identifiers;
• browser and device information;
• operating system information;
• approximate geographic information;
• referral or traffic-source information;
• pages viewed;
• interactions with Site features;
• session information;
• dates and times of visits; and
• Internet Protocol (“IP”) address information during data collection.

Google processes Analytics information according to its own terms, policies, and data-processing practices.

We do not intend to use Google Analytics to collect the diagnosis, treatment information, application responses, names, or other sensitive personal information that families intentionally enter into a Triumph Together application.

Our Site configuration should be maintained so that sensitive application information is not intentionally transmitted to Google Analytics through page URLs, custom events, analytics parameters, or similar tracking mechanisms.

Depending on your browser, device, location, and our Site configuration, you may be able to limit analytics through cookie controls, consent settings, browser settings, or tools provided by Google.

7. Cookies and Similar Technologies

The Site and our service providers may use cookies, pixels, local storage, or similar technologies.

These technologies may be used to:

• allow the Site to operate;
• remember preferences;
• provide security features;
• maintain website functionality;
• understand website traffic and usage;
• measure Site performance; and
• improve the visitor experience.

Some cookies may be necessary for the Site to function. Other cookies, including certain analytics cookies, may be optional depending on applicable law and our Site configuration.

8. Donations and Payment Information

Depending on the transaction, we may receive information such as:

• donation designation;
• billing information; and
• limited transaction or payment confirmation information.

We may not directly receive or store complete payment card numbers when payment information is processed directly by a third-party payment provider.

Payment processors collect and process information according to their own privacy policies and terms.

We may retain appropriate donation and transaction records for accounting, tax, legal, fraud-prevention, and nonprofit recordkeeping purposes.

9. Email Communications

If you subscribe to updates, donate, apply for an experience, contact us, or otherwise provide your email address, we may use your email address to communicate with you concerning the reason you contacted us.

If you separately subscribe to newsletters, fundraising communications, or other promotional messages, we may send those communications as permitted by law.

You may unsubscribe from promotional emails by using the unsubscribe mechanism included in those messages.

Even if you unsubscribe from promotional messages, we may continue sending non-promotional communications that are reasonably necessary to administer an application, experience, donation, transaction, or other relationship with you.

10. Photos, Video, Stories, and Publicity

Triumph Together experiences may be photographed, recorded, or described in stories, social media posts, news coverage, fundraising materials, or other communications.

When appropriate, particularly when a child is involved, we may request a separate media, photography, video, testimonial, or publicity release from a parent or legal guardian.

Submitting an application does not by itself give us unrestricted permission to publicly disclose a child’s medical information or use a child’s name, photograph, image, voice, or likeness for promotional purposes unless that authorization is separately and clearly provided.

Information that you or a family member independently publishes publicly, including information posted to social media, may be visible to others outside our control.

11. Social Media

The Site may contain links to or integrations with social media services.

If you interact with Triumph Together through social media, the applicable social media provider may collect information about your interaction in accordance with its own privacy practices.

Information you choose to make publicly available through social media may be viewed, copied, or shared by other users.

12. Third-Party Websites and Services

The Site may link to websites and services operated by athletes, sports teams, universities, leagues, event venues, payment processors, social media platforms, sponsors, news organizations, or other third parties.

This Privacy Policy does not govern websites or services that we do not operate.

We encourage you to review the privacy policies of third-party services before providing them with personal information.

13. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including administering applications and experiences, maintaining organizational records, fulfilling legal or accounting requirements, resolving disputes, and protecting our organization and participants.

Retention periods may differ depending on the type and sensitivity of information.

When personal information is no longer reasonably necessary, we may delete, anonymize, aggregate, or securely dispose of it, subject to legal, contractual, archival, insurance, or recordkeeping requirements.

We seek to avoid retaining sensitive health-related application information longer than reasonably necessary for the purposes for which it was collected.

14. Data Security

We use reasonable administrative, organizational, and technical measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no website, electronic transmission, database, or storage system can be guaranteed to be completely secure.

You should use caution when sending sensitive information electronically and should not send unnecessary medical records, financial information, identification documents, or other highly sensitive information unless specifically requested through an appropriate method.

If we become aware of a security incident involving personal information, we will evaluate and respond to the incident in accordance with applicable law.

15. Your Privacy Choices and Rights

Depending on where you live and applicable law, you may have certain rights concerning your personal information.

These may include the right to:

• request information about personal information we maintain about you;
• request access to certain personal information;
• request correction of inaccurate information;
• request deletion of certain information;
• request a portable copy of certain information;
• withdraw consent where processing is based on consent;

• appeal certain decisions concerning a privacy request where required by law.

These rights are not absolute and may be subject to exceptions.

For example, we may need to retain certain information to comply with legal obligations, maintain appropriate nonprofit or financial records, establish or defend legal claims, prevent fraud, or complete an experience or transaction that you requested.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

16. Privacy Requests

To make a privacy request concerning yourself or a child for whom you are the parent or legal guardian, contact us using the information at the end of this Privacy Policy.

Please describe your request and provide enough information for us to reasonably identify the relevant records.

To protect the privacy of children and families, we may need to verify your identity or your authority to act on behalf of another individual before fulfilling a request.

If applicable law gives you a right to appeal our decision concerning a privacy request, we will provide information regarding the applicable appeal process.

17. Sale or Sharing of Personal Information

We do not intend to sell personal information provided through Triumph Together applications in exchange for money.

We also do not intend to sell or commercially distribute sensitive information concerning a child’s diagnosis or treatment.

Certain privacy laws define terms such as “sale,” “sharing,” or “targeted advertising” more broadly than an exchange of information for money. Depending on the technologies used on the Site and how they are configured, disclosures involving analytics or other third-party technologies may be treated differently under various state privacy laws.

Where applicable law requires an opt-out or consent mechanism for such technologies, we will provide the applicable choice or control.

18. Children’s Privacy Requests

A parent or legal guardian who believes that a child has submitted personal information directly to us without appropriate authorization may contact us and request that we review or delete the information.

We may need to take reasonable steps to verify the requestor’s identity and relationship to the child before providing access to or deleting information.

Our application process is intended to involve a parent, legal guardian, or appropriately authorized adult when information concerning a minor is submitted.

19. Residents of Certain U.S. States

Privacy laws in certain U.S. states may provide residents with additional rights concerning their personal information.

Where such laws apply to Project Outrun or Triumph Together, we will process eligible privacy requests in accordance with applicable requirements.

The categories of information we may collect are described in Section 1 of this Privacy Policy. Our purposes for collecting and using information are described principally in Sections 2 through 4. The categories of parties with whom information may be disclosed are described principally in Sections 5 through 12.

If applicable law requires additional disclosures or rights beyond those described here, those requirements will apply notwithstanding anything in this Privacy Policy to the contrary.

20. International Visitors

Triumph Together and Project Outrun are based in the United States.

If you access the Site or provide information from outside the United States, your information may be processed or stored in the United States or other countries where our service providers operate.

Privacy and data-protection laws in those countries may differ from those in your country of residence.

Where legally required, we will take appropriate measures concerning international transfers of personal information.

21. Do Not Track and Privacy Signals

Some browsers and devices provide privacy signals or settings intended to communicate a user’s tracking preferences.

Because technical standards and legal requirements concerning these signals continue to evolve, the Site’s response may depend on the particular signal, technology, jurisdiction, and Site configuration.

We will honor legally recognized privacy preference signals where required by applicable law.

22. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes to our programs, technology, information practices, service providers, or legal requirements.

When we update the Privacy Policy, we will revise the Effective Date at the top of this page.

If changes materially affect how we handle information already collected, we will take additional steps when required by applicable law.
